Limited Liability Waiver & Assumption of Risk Agreement

This Limited Liability Waiver & Assumption of Risk Agreement (“Agreement”) is a legally binding document between Z1 Fencing Club (“Z1,” “we,” “our,” or “the Club”) and the undersigned participant (“Participant”) or the parent/legal guardian of a minor participant (“Guardian”).

By signing this Agreement, you acknowledge that you have read, understood, and voluntarily accept the terms below as a condition of participation in fencing classes, private lessons, camps, tournaments, open fencing sessions, physical training and any other activities hosted by Z1 Fencing Club (“Activities”).

Acknowledgment of Risks

I understand and acknowledge that Fencing is a physical sport involving fast-paced movements, contact, and the use of blades. Injuries, though minimized through proper safety equipment and instruction, cannot be entirely eliminated.

Possible risks include, but are not limited to:

• Cuts, bruises, sprains, and muscle strains
• Concussions and other head injuries
• Eye injuries, even with protective masks
• Broken bones or joint injuries
• Allergic reactions or illness
• Severe injury, disability, or in rare cases, death

Injuries may occur due to my own actions, the actions of others, equipment failure, or facility conditions. Participation in group athletic activities also carries the inherent risk of exposure to COVID-19 or other communicable diseases.

I understand that the risks described are inherent to the activity of fencing and cannot be eliminated without jeopardizing the essential qualities of the sport.

By signing this Agreement, I voluntarily assume all risks, whether known or unknown, associated with my participation or my child’s participation in Activities at Z1 Fencing Club.

Release of Liability

In consideration of being allowed to participate in Activities, I, on behalf of myself, my child (if applicable), and our heirs, executors, administrators, and assigns, fully release, waive, and discharge Z1 Fencing Club, its owners, officers, directors, employees, instructors, coaches, volunteers, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action related to:

• Personal injury, illness, or death
• Damage to personal property
• Financial losses or expenses incurred as a result of participation

This includes but is not limited to claims brought by other participants, spectators, or third parties for injuries or damages allegedly caused by me or my child.

This release applies to the fullest extent permitted by law, except to the extent caused by gross negligence or willful misconduct of Z1 Fencing Club or its representatives.

If the Participant is a minor, the undersigned parent/guardian acknowledges the risks described above on behalf of the minor Participant and agrees to indemnify and hold harmless Z1 Fencing Club from any claims, damages, or costs arising from the minor’s participation, to the fullest extent permitted by New York law. Indemnification & Hold Harmless

I agree to defend, indemnify, and hold harmless Z1 Fencing Club, its coaches, employees, and affiliates from any claims, damages, costs, expenses, or liabilities (including attorney’s fees) resulting from:

• My participation or my child’s participation in Activities
• My failure to follow safety guidelines or staff instructions
• Any damage caused by me or my child to equipment, facilities, or other participants

Safety & Equipment Policy

I understand and agree that:

• Required protective equipment — including fencing masks, jackets, gloves, underarm protectors, and plastrons — must be worn at all times during Activities.
• I am responsible for ensuring that my personal equipment meets required safety standards.
• If using Z1-provided equipment, I will handle it with care and report any damage or safety concerns immediately.
• Failure to follow safety rules or instructions from coaches may result in suspension or removal from Activities without refund.

Health & Medical Consent

I certify that I (or my child) am physically and mentally fit to participate in fencing and related Activities.

• I assume full responsibility for any medical expenses arising from injuries or illnesses incurred at Z1 Fencing Club.
• In the event of a medical emergency, I authorize Z1 Fencing Club staff to provide basic first aid, secure emergency medical care, and arrange transportation if necessary.
• I further agree to be responsible for all medical costs not covered by my insurance, and I release Z1 Fencing Club from any liability for any good faith actions taken in connection with medical treatment.

Photo & Media Release (Optional)

I grant Z1 Fencing Club permission to use photographs, videos, and other media of me or my child taken during Activities for marketing, social media, and promotional purposes without compensation.

COVID-19 & Communicable Disease Notice

I understand and accept the following:

• Participation in group training carries a risk of exposure to COVID-19 and other contagious illnesses.
• Z1 Fencing Club follows safety protocols, but cannot guarantee a completely risk-free environment.
• I agree not to attend Activities if I (or my child) exhibit symptoms of illness or have been exposed to a communicable disease.

Severability & Governing Law

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under New York law, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

This Agreement shall be governed by the laws of the State of New York. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Westchester County, New York, and the parties consent to the jurisdiction of such courts.

By enrolling, I confirm that:

• I have read and understood this Limited Liability Waiver.
• I understand the inherent risks of fencing and related activities.
• I voluntarily agree to assume all risks and release Z1 Fencing Club from liability as outlined above.
